But “most of the time” isn’t good enough when it comes to your children.

The Gap Nobody Talks About

Here’s what a lot of parents don’t realize: a will doesn’t protect your child in the first hours of an emergency. It can take weeks — sometimes longer — before a will is even processed through court. In the meantime, even your most trusted family member may not have the legal authority to authorize medical care, make school decisions, or simply take your child home.

In some cases, children end up temporarily in the care of strangers through child protective services — not because no one loved them, but because no one had the legal authority to act.

Who Steps In Right Away?

Most people only think about naming a permanent, long-term guardian— but we also recommend naming someone who can step in immediately, in the hours before any court is involved. That person has legal authority to act right away, so your child’s care never falls into a gap.
